Terms of Service

These Terms of Service ("Terms") govern your use of CurlyFry.ai ("CurlyFry", "the Platform"), operated by 419 Technology ("we", "us", or "our"). By creating an account or using the Platform, you agree to these Terms.

1. Account Registration

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• One person or organization may not maintain more than one free trial account.
• You must be at least 18 years old to use the Platform.

2. Subscription and Billing

• CurlyFry offers tiered subscription plans (Starter, Pro, Enterprise) billed per manager per month.
• Engineers and team members added to the platform are free and do not count toward billing.
• All plans include a 14-day free trial. No credit card is required to start a trial.
• Payment is processed securely via Stripe. We do not store credit card information.
• You may upgrade, downgrade, or cancel your subscription at any time. Changes take effect at the next billing cycle.
• Refunds are not provided for partial billing periods.

3. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or to violate any applicable laws.
• Upload content that infringes on intellectual property rights.
• Attempt to gain unauthorized access to other users' accounts or data.
• Reverse-engineer, decompile, or disassemble any part of the Platform.
• Use automated tools to scrape, crawl, or extract data from the Platform.
• Resell or redistribute access to the Platform without our written consent.

4. Data Ownership

• You retain ownership of all data you upload to the Platform (meeting transcripts, recordings, etc.).
• You grant us a limited license to process your data as necessary to provide the Platform's features.
• AI-generated analyses (summaries, sentiment scores, action items) derived from your data are part of the service and accessible through your account.
• We do not use your data to train AI models or share it with other customers.

5. Data from Third-Party Integrations

When you connect Jira or other third-party services, you authorize us to access and process the data necessary to provide our features (sprint tickets, story points, assignees, etc.). You are responsible for ensuring you have the right to share this data with CurlyFry.

6. Service Availability

• We strive for high availability but do not guarantee 100% uptime.
• We may perform scheduled maintenance with reasonable notice.
• We are not liable for downtime caused by third-party services (Jira, Anthropic, Stripe, etc.).

7. Limitation of Liability

CurlyFry is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

8. Termination

• You may cancel your account at any time through the billing portal.
• We may suspend or terminate accounts that violate these Terms.
• Upon termination, your data will be retained for 30 days to allow for export, then permanently deleted.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
